Drafting Complex Property Documentation

This workshop focuses on some of the more complex commercial property documents. Delegates will consider a number of different specimen clauses and how to protect their clients' position while making the appropriate compromises to ensure that the deal is done. Numbers are limited to 25 to ensure that the objectives of the course are achieved.

The following will be covered:

• Agreements for lease subject to building obligations:

- Measurement, extensions of time, liquidated damages and long stop dates

• Contracts conditional upon planning:

- Obligations to apply for planning

• Overage agreements:

- Anti avoidance provisions, security

• Options: why use an option rather than a conditional contract? The option period; how to exercise the option; phased options
