Occupational illness claims continue to take up a good section of a PI practitioner's time. The higher courts are regularly visited on disease-related matters, and in recent years issues of foreseeability, apportionment, knowledge and causation have all been the subject of important decisions. With the cost of investigation such cases growing, and with conditional fee agreements being the norm, the risk of those instructed in disease cases is greater than it ever was. This course is designed to consider the working method for disease litigation and then look at the recent decisions of the Court of Appeal/House of Lords in relation to all aspects of disease litigation, with particular emphasis on the following:
- The Disease and Illness Protocol 2003 and its effectiveness
- Asbestos-related illnesses
- Occupational stress
- Hand arm vibration syndrome
- Upper limb disorders
- Medical issues of condition, causation and foreseeability
- Apportionment of damages
