Banking law questions can arise in many different situations and types of practice. This course aims to give a good practical understanding of the legal and regulatory framework for banking, an insight into areas where disputes are often encountered and an overview of the most relevant current issues and cases.
It will cover:
- The UK Banking System, how it works and the role of banks
- How banks are regulated for their main activities, the role of consumer protection legislation and the Banking Codes, proposals for reform of retail banking regulation
- Banks and account holders, rights and obligations of each, impact of online and internet banking
- The law relating to bank payments, including cheques and electronic fund transfers, impact of Payment Services Directive
- Credit and debit cards
- Bank lending - ways in which banks lend to businesses and consumers, and relevant law (including regulation on consumer credit and mortgage lending)
- Security for lending to businesses and consumers, common forms of security such as mortgages, debentures and guarantees, potential problem cases, e.g. Etridge cases and undue influence
- How Banks support trade finance, looking at bank guarantees, performance bonds, bills of exchange and documentary credits
- Recourse against banks if things go wrong, including the Financial Ombudsman Scheme and the Financial Services Compensation Scheme
- Current issues, cases, investigations and legislation
